That's a great image of Boas, and there's no doubt the copyright has expired. However, the American Philosophocal Society may still retain a proprietary right in any derivative image from an item in their collections.

The APS's own website states:

"Copies are prepared solely for the use of the researcher and may not be placed in other repositories without the prior written permission of the APS"

They do not have a clearly articulated policy on electronic images from their site, but I fear that "other repositories" may be interpreted to mean online ones. I would urge that you get a clearance from them to use this image.

I received a reply from the American Philosophical Society and we may use this image, but under permission. I mailed the necessary paperwork this morning, and will post a scan of the permission as soon as it comes back with the proper signatures. --Joe Quick (Talk) 10:45, 7 May 2007 (CDT)

Free versions

Here's the original 1888 publication of the photo. That version is obviously in bad shape but I'm working on finding a less restricted version. I'm sure that the American Philosophical Society isn't the only institution with a copy. This book cites them along with the original - presumably they got it from the APS. Great find! The APS says their holding is "original, encased in Mylar". When this is not the case with other photos in the collection, they state it is a "reproduction". So if someone holds a good reproduction... ;-)  —Stephen Ewen (Talk) 21:08, 13 October 2007 (CDT)
